Abstract

The German Court of Arbitration for Sport is a private and independent entity devoted to sports-related dispute resolution. Since its foundation in 2008, it has become an integral pillar in the anti-doping fight. But also beyond the fight against doping, the German Court of Arbitration for Sport may be seized in order to resolve sports-related disputes. In view of that, this article examines its organizational structure and analyzes its Arbitration Rules, which were created specifically for the resolution of sports-related disputes.
The introductory remarks give an overview of the legal framework concerning sports arbitration in Spain and in Germany and depict the different approaches in both legal systems. In the following, the functional and working methods as well as the tasks and responsibilities of the German Court of Arbitration for Sport are described. Subsequently, the focus is put on the Arbitration Rules of the German Court of Arbitration for Sport. In this context, the articles of the sports-related Arbitration Rules, which form the procedural basis for the conduct and administration of arbitration proceedings before the German Court of Arbitration for Sport, are delineated. Since April 1, 2016, the second, revised version of the Arbitration Rules of the German Court of Arbitration for Sport applies.
